Applebee’s fires waitress for exposing pastor’s ‘give God 10%’ no-tip receipt

A waitress says she was fired from her job at Applebee’s after posting a note from a pastor who refused to tip, writing that “I give God 10% Why do you get 18.”

The waitress, who identified herself only as Chelsea, told The Consumerist that she originally posted the photo on the atheist section of social media website Reddit as a “lighthearted joke.”

“I thought the note was insulting, but it was also comical,” she explained. “I posted it to Reddit because I thought other users would find it entertaining.”

On the receipt she posted, Applebee’s computer system had added an automatic 18 percent gratuity because the dinner party had eight or more people. But the customer scratched out the $6.29 tip and wrote “0.” The receipt included a note about giving God 10 percent and a signature which indicated that the diner was a “pastor.”

“My mistake sir, I’m sure Jesus will pay for my rent and groceries,” Chelsea wrote on Reddit on Wednesday along with a photo of the receipt.

The waitress said that the she failed to redact the signature because she thought it was illegible, but Internet sleuths began using it to obtain the pastor’s identity.

“I had already started receiving messages containing Facebook profile links and blogs and websites, asking me to confirm the identity of the customer,” she recalled. “I refused to confirm any of them, and all of them were incorrect. I worked with the website moderators to remove any personal information. I wanted to protect the identity of both my fellow server and the customer. I had no intention of starting a witch hunt or hurting anyone — I just wanted to share a picture I found interesting.”

On Wednesday, the pastor reportedly contacted the Applebee’s location where she worked and demanded that everyone involved — including the managers — be fired.

“When I posted this, I didn’t represent Applebee’s in a bad light,” Chelsea explained. “In fact, I didn’t represent them at all. I did my best to protect the identity of all parties involved. I didn’t break any specific guidelines in the company handbook — I checked.”

“But because this person got embarrassed that their selfishness was made public, Applebee’s has made it clear that they would rather lose a dedicated employee than lose an angry customer. That’s a policy I can’t understand.”

She added that she was “utterly baffled” about why someone would connect Christian tithing to tips that wait staff rely on tips to pay their bills.

“I’ve been stiffed on tips before, but this is the first time I’ve seen the Big Man has been used as reasoning,” she said. “If this person wrote the note, obviously they wanted it seen by someone… It’s strange to me that now that the audience is wider than just the server, the person is now ashamed.”

Facebook Tests Timeline Design With Activity On Left, Posts On Right

Last month, social media expert Mari Smith found out that Facebook was testing a redesign to a proposed one-column timeline layout. According to sister site Inside Facebook, it appears that another design is being tested, as well — one that places open graph activity on the left and posts on the right.

Panetta Removes Ban on Women in Combat

The Defense Department was being sued by two women for the right to serve in combat:

WASHINGTON (AP) — Senior defense officials say Pentagon chief Leon Panetta is removing the military's ban on women serving in combat, opening hundreds of thousands of front-line positions and potentially elite commando jobs after more than a decade at war.

The groundbreaking move recommended by the Joint Chiefs of Staff overturns a 1994 rule banning women from being assigned to smaller ground combat units. Panetta's decision gives the military services until January 2016 to seek special exceptions if they believe any positions must remain closed to women.

Fergawdsakes:

The American Civil Liberties Union filed a Freedom of Information Act request with the FBI seeking details of its surveillance policy -- who it spies upon, and how, and under what circumstances. The FBI sent back two 50+ page memos in reply, each of them totally blacked out except for some information on the title page.

Seriously. They did that.

American justice: Pregnant and hog-tied

Pregnant and hog-tied

by digby

Isn't this special?

A pregnant woman who was pulled over for talking on her cellphone — and then hurled to the ground and hogtied by CHP officers on the shoulder of the busy Harbor Freeway — has been paid $250,000 in damages.

The 30-year-old woman was charged with resisting arrest and driving with a suspended license, but the charges were dropped after a judge was shown a video of the incident, captured on a camera mounted on the dashboard of a California Highway Patrol cruiser.

You'll see why:

Once she pulls to the shoulder, after first pulling into the fast lane and appearing to cut off other drivers, a pair of CHP officers orders her to toss out her car keys, get out of her dark green Dodge Caravan and put her hands on the vehicle.

Instead, the video shows, she stands and stares at the patrolmen, appearing confused. Officers, in their official report, said she appeared to raise her arms in a menacing manner.

The action caught on the video picks up quickly from there:

Guns drawn, the officers approach the driver, and one of the patrolmen sweeps away her legs with a kick and pushes her face-first to the asphalt. Another officer then presses his knee into the woman's back and pins her to the ground.

At another point, it appears the woman is kicked in her left ribs. Eventually she is hogtied and placed in a squad car.

"I'd never seen a gun for real before," Gaglione said later. "I just froze. I was scared they'd shoot me."

Gaglione said she told the officers she was pregnant when they first approached her, but Officer Daniel Hernandez — one of the initial officers on the scene — said she didn't mention that until she was on the ground.

Hernandez said in his report that he kneed the woman in an effort to distract her so that his partner, Officer Roberto Martinez, could handcuff her.

In their report, the officers said the incident had escalated because the woman had ignored their orders and appeared to raise her arms in an aggressive manner after hopping out of the van.

The cops are all still on the job.

Oh, and by the way, it's a miracle the judge ever saw this video. If he hadn't, the victim would have very likely been convicted of resisting arrest:

When Tamara Gaglione was stopped on the side of a freeway for talking on her cellphone, she had no idea she'd end up hogtied and lying face down in the back of a police car.

But that's exactly what happened to the 30-year-old woman, 2 months pregnant at the time. When California Highway Patrol officers pulled her over to the side of the 110 highway Aug. 30, 2011, they slammed her to the ground, hogtied her and shoved her in the back of their patrol car.

On the way to the station, she could hear officers discussing video of the encounter candidly, said attorney Howard Price to The Huffington Post. But when Price requested the video as evidence for Gaglione's criminal trial, he was told there was no footage of the incident.

"I went back to them, and I said, 'Look, am I stupid? This involved a chase. There must be a videotape,'" said Price. Eventually the prosecutor handed over footage from a backup officer's camera, which showed nothing.

Finally, he was told the footage existed, but that no one could transfer the data to another medium -- so he had to go to the CHP station himself to view it. Price made sure to record the footage for himself, and he uploaded the shocking video to YouTube.

I wonder if all lawyers are that persistent? I doubt it.

There are lots of budget problems here in California. You'd think the authorities would be a little bit more concerned about having to pay out quarter million dollar settlements for yahoo cops who have the judgement of hot-headed teenagers. At the very least you'd think they would get rid of employees who cost the taxpayers this kind of money.

Crouching Tiger, Hidden Powers

(Street Vendor | Queens, NYC, NY, USA)

(I’m half-Chinese, but with my sunglasses on, people usually can’t tell. I’m fluent in Mandarin. One day I get a text from my friend, a grade-school teacher.)

Friend: “You speak Chinese, right?”

Me: “Yeah, why?”

Friend: “Come down to [intersection] around noon and explain what the f*** is going on.”

(At my lunch break I head down there. On one side of the street is a crowd of school kids, while on the other side an elderly Chinese man with an ice cream cart.)

Kid #1: “I’m gonna do it.”

Kid #2: “No way.”

Kid #1: “Yeah way. I’m fast enough!”

Kid #2: “You’re not Chinese.”

Kid #1: “So?”

Kid #2: “Only [Chinese name] can do it.”

Kid #1: “I’m gonna do it.”

(Kid #1 dashes across the street, yanks back the cover of the cart, and grabs a handful of ice cream. He takes off, but the vendor catches him, pinning both arms behind his back.)

Vendor: “Ah, three bars? Your total is $9.28.”

Kid #1: “Lemme go!”

(The vendor removes some money from the kid’s pocket with his free hand.)

Vendor: “Cash paid is $20.”

Kid #1: “Yeah, yeah, I know the drill.”

(While still holding the struggling kid, the vendor deposits the $20 in his till and takes out change.)

Vendor: “Your change is $10.72.”

(The vendor puts the change and ice creams in a bag and hands them to the kid, who takes off.)

Vendor: “Have a nice day!”

Kid #2: “Told you.”

Kid #1: “Fine! Okay, [Chinese name], you do it!”

(A short Chinese boy steps forward. His clothes are patched and despite the weather, he’s not wearing a coat.)

Chinese Kid: “Let us meditate… on the way of the wind.”

(He strikes a ridiculous pose and exhales loudly. The other kids jump back.)

Chinese Kid: “…on the way of the snake…”

(New pose, hissing loudly. The others back away even more.)

Chinese Kid: “…on the way of the hawk.”

(He flaps his arms and jumps in a circle. The kids are a good twenty feet away now.)

Chinese Kid: “The meditation is done.”

(He runs up to the ice cream vendor and grabs a handful of bars. The vendor strikes him with an exaggerated karate chop which the kid easily blocks.)

Chinese kid: *flees, speaking Chinese* “Thank you, Mr. [Name]!”

Vendor: *shakes his fist angrily, also in Chinese* “Sorry, we are out of lime today!”

(The Chinese kid kicks towards the vendor from across the street.)

Chinese kid: “My mother says she hopes your leg feels better!”

Vendor: *red-faced with rage* “It does! Tell her thank you for the tea!”

(The kids are enthralled. As they eat the ice cream, I approach the vendor.)

Me: *in Chinese* “What just happened?”

Vendor: “Oh… you understood. That little boy is a new immigrant, and all the other children mocked him because he is small and weak. He told them Chinese people have special powers, and they beat him up and told him to prove it. But I overheard and whispered to him to rob me. Now we have a deal.”

Me: “How wonderful!” *pointing behind him* “Hey, can you tell what that is?”

(As he turns around, I drop some money on the cart and grab a bar of ice cream, fleeing.)

Vendor: “You forgot your change!”

Me: *shakes my fist* “It’s a tip!”

Kids: “Whoa! How did you do that?”

(I slip off my sunglasses. The Chinese kid bows to me and I bow back.)

Kid #2: “Told you they have special powers. Never bully a Chinese kid, man. Never!”

Expert witness describes Aaron Swartz's "crimes"

Alex Stamos, a computer security and forensics expert, was one of the expert witnesses in US v Swartz, the vindictive case brought against Aaron Swartz for walking into an unlocked computer closet, and downloading a large number of academic articles from JSTOR, using MIT's network. Stamos has very good perspective on the "crimes" for which Aaron was being hounded by the state:

* At the time of Aaron’s actions, the JSTOR website allowed an unlimited number of downloads by anybody on MIT’s 18.x Class-A network. The JSTOR application lacked even the most basic controls to prevent what they might consider abusive behavior, such as CAPTCHAs triggered on multiple downloads, requiring accounts for bulk downloads, or even the ability to pop a box and warn a repeat downloader.

* Aaron did not “hack” the JSTOR website for all reasonable definitions of “hack”. Aaron wrote a handful of basic python scripts that first discovered the URLs of journal articles and then used curl to request them. Aaron did not use parameter tampering, break a CAPTCHA, or do anything more complicated than call a basic command line tool that downloads a file in the same manner as right-clicking and choosing “Save As” from your favorite browser.

* Aaron did nothing to cover his tracks or hide his activity, as evidenced by his very verbose .bash_history, his uncleared browser history and lack of any encryption of the laptop he used to download these files. Changing one’s MAC address (which the government inaccurately identified as equivalent to a car’s VIN number) or putting a mailinator email address into a captured portal are not crimes. If they were, you could arrest half of the people who have ever used airport wifi.

* The government provided no evidence that these downloads caused a negative effect on JSTOR or MIT, except due to silly overreactions such as turning off all of MIT’s JSTOR access due to downloads from a pretty easily identified user agent.

* I cannot speak as to the criminal implications of accessing an unlocked closet on an open campus, one which was also used to store personal effects by a homeless man. I would note that trespassing charges were dropped against Aaron and were not part of the Federal case.

Aaron hanged himself two years, to the day, after his arrest. The DoJ asked for the maximum penalty: 30 years.
