Downtown Champaign shoppers can use parking deck free

CHAMPAIGN — During December, drivers who spend at least $5 at a downtown Champaign business or restaurant will be allowed up to four hours of free parking at the Hill Street parking deck on the same day as their purchase.

The offer has become an annual promotion to encourage and thank customers who patronize downtown businesses, according to a press release from the city.

Hostess asks judge to approve additional $1.8 million in executive bonuses

Texas-based Hostess Brands Inc. asked a judge on Wednesday to approve an additional $1.9 million in executive bonuses, according to The Associated Press, saying the money is needed to keep top managers on as the company sells off all its assets.

The now-defunct company, which rakes in more than $2.5 billion in annual sales, closed its doors earlier this month amid a strike by its unionized workers who refused to accept wage cuts. Despite still-heavy sales, the company declared bankruptcy twice in recent years as its revenues gradually fell. Many critics blamed the company’s net loss of $1.1 billion in FY 2012 on its failure to diversify into more healthy snacks.

The company’s most recent court filing asks New York-based bankruptcy Judge Robert Drain to give final approval of managements plans to liquidate its assets.

If approved, the move would be the final defeat for the company’s union, which saw Judge Drain order significant concessions from the workers earlier this month.

In addition to laying off more than 18,000 workers, the company stopped contributing to its union pension plans some time ago and now owes workers more than $111 million.

Gregory Rayburn, the company’s interim CEO, told The Dallas Morning News on Wednesday that more than 80 firms have lined up to buy out the company’s assets, in a series of sales that could pull in more than $1 billion. It is possible that the unionized workers could be hired on by one of those other companies.

Parents charged with forcing Aspergers teen into ‘military style’ punishment

A Minnesota couple was charged with misdemeanor crimes this week after authorities removed a 15-year-old boy who’d been forced to live under constant video surveillance in a dark room, only being allowed to leave to participate in “military style” exercises allegedly forced upon him by his stepfather.

Neighbors reportedly noticed the odd behavior too: one even snapped a photo of Gregory Danner working in his back yard wearing nothing but a pink thong, and said they could often hear him shouting at his stepson.

The teen, who authorities did not name, reportedly has Asperger’s syndrome, a type of autism that causes awkwardness and clumsiness. Minnesota Fox affiliate KMSP-TV added that his parents covered the windows, removed his light bulb and forced the teen to sleep on the floor.

That alarmed authorities who began investigating the case in April, and parents Angela and Gregory were ordered to change their treatment of the boy. The teen told investigators a month later that they did not, and instead forced him into even more harsh exercises.

“This was a 15-year-old boy,” Dakota County Attorney James Backstrom told KMSP. “He wasn’t a Marine recruit. Being put through that type of military-style exercise on a daily basis and being required to sleep on the floor in a dark room with the windows shaded off so no light came in… That is a very unusual circumstance, and one which we think crosses the boundary of what’s appropriate under the law.”

The boy is now living with his natural father, and the Danners face up to two years in jail.

Fewer Judges Confirmed Under President Obama Than Any First Term President Since Kennedy

According to data from the Federal Judicial Center, the rate of judicial confirmations under President Obama is slower than the rate during any president’s first term since the term begun by President John F. Kennedy in 1961. The chart below includes all Article III federal judicial confirmations during a president’s first term. As the purpose of the chart is to compare President Obama’s first term to the same period in prior presidencies, it does not include President Gerald Ford because Ford’s presidency completed what began as President Richard Nixon’s second term. The chart does include the entire four year term that began under Kennedy and ended under President Lyndon Johnson:

Although the chart indicates that more judges were confirmed under President Obama than during the Kennedy/Johnson term and that Obama’s confirmation rate is only slightly lower than President Ronald Reagan’s, these numbers are deceptive. Today the federal bench includes 870 authorized active judgeships, including the nine justices of the Supreme Court. This is more than twice the 407 judgeships authorized under President Kennedy and significantly more than the 757 judgeships authorized at the end of President Reagan’s first term. So the Senate confirmed fewer judges under President Obama despite the fact that Obama had more judgeships to fill.

To be sure, President Obama has not been as aggressive as he should have been in naming new judges and throwing his political support behind his existing nominees. But the single biggest obstacle to judicial confirmations under Obama is the record intransigence shown by Senate Republicans. Nearly one quarter of all attempts to break a filibuster on a presidential nominee during the first 221 years of the American republic involved Senate Republican filibusters of President Obama’s nominees.

It is not too late, however, for the Senate to back away from its lowest judicial confirmation rate since the Johnson Administration. Nineteen judicial nominees await confirmation votes on the Senate floor, most of whom are completely uncontroversial.

Virginia Man Released From Prison After Four Years For Crime He Did Not Commit

Freed Virginia Inmate Johnathon Montgomery

Last month, a woman who accused Virginia inmate Johnathon Montgomery of sexually assaulting her when Montgomery was 14 and she was 10 completely recanted that testimony. A judge ordered Montgomery freed shortly thereafter at the urging of both the local prosecutors and Montgomery’s defense attorneys.

Yet, thanks to a quirk of Virginia law, Montgomery nearly lost his opportunity to spend this Thanksgiving with his family — Virginia law prevents lower court judges from issuing such orders more than 21 days after trial, and Montgomery spent nearly four years in prison.

To his credit, Gov. Bob McDonnell (R-VA) sidestepped this problem by granting Montgomery a conditional pardon allowing him to be freed before a court can act. Under McDonnell’s pardon, Montgomery must file a “writ of actual innocence” within 30 days of his release from prison. He also will remain on probation and will be forced to register as a sex offender pending further court action.

Zero Students Opt For University Of Colorado’s Gun Dorm

The University of Colorado has found no takers for its newly-created dorms for students with concealed-carry permits. Though both its Boulder and Colorado Springs campuses began offering segregated dorms for those students who wish to keep their concealed weapons in their dorms in August, a university spokesman told the Denver Post “so far, no one has moved.” Guns are prohibited in all other campus dormitories. The creation of the dorms followed a March ruling by the state’s supreme court that the school could not outright ban concealed weapons on campus.

What To Do If You’re Still Getting Calls From “Rachel At Cardholder Services”

Last week, the Federal Trade Commission shut down five operations responsible for untold number of scammy robocalls from “Rachel (or one of many other names) at Cardholder Services.” But several readers have written in to say that these calls have not ended.

“We know there are lots of bad guys,” William Maxson, an attorney for the FTC’s Bureau of Consumer Protection, tells Consumerist, adding that even though the agency was able to bring the hammer down (my phrasing, not his) on five major scammers, “There are others out there that use the same methods.”

The FTC confirms that there are ongoing investigations into other robocallers, though it can’t offer specifics since telling scammers that you’re about to bust them is not always the best way to catch them.

For people that continue to get robocalls from Cardholder Services or any other potential scam, Maxson says the fastest and easiest way to let the FTC know is to go to DoNotCall.gov and click “File a Complaint.” You can also call (888) 382-1222 to file a complaint with the FTC.

Remember, even if you’re not listed in the Do Not Call Registry, it is illegal for businesses to robocall you without your permission.

Big gay victory celebration in Minnesota

Check out this wonderful, cockle-warming video, taken from inside the war room of Minnesotans United for All Families, on election night. Minnesota voters were given the chance to write discrimination against LGBT Minnesotans into the state constitution. Minnesota’s gay marriage amendment, unlike those in Maine, Maryland, and Washington State, was a chance for voters to say “no” to restricting rights rather than saying “yes” to broadening rights. Minnesotans said “hell no” to reserving marriage rights just for straight people.

In this video, the campaign manager of MUAF, Richard Carlbom, is in the middle of thanking his campaign staff and volunteers and warning them that it’ll be a while before they get a result… and then they get a result. The room goes wild and the person who was, up until then, diligently filming Carlbom’s speech, starts hugging people and filming their jackets. It’s terrible camera work, but who cares? Suck it, discrimination.
